Hazardous Waste Remedial Action Fees

Hazardous Waste Generators are responsible for reporting their waste to both the Division of Solid Waste and the Division of Remediation. This section discusses the reporting process (Form RF-FDS) for the Division of Remediation. You can find information on the Division of Solid Waste’s process on the Division of Solid Waste website

The Hazardous Substance Remedial Action rule (chapter 0400-15-01) establishes a Remedial Action Fund (“the Fund”). The Division of Remediation uses the Fund to investigate and cleanup environmental problems caused by the release of hazardous substances into the environment.

Hazardous Waste Remedial Action Fees are deposited into the Fund. By March 1st of every year, hazardous waste generators must send a Hazardous Waste Remedial Action Fee Report (Form RF-FDS) to us. This report documents how much waste you generated and how that waste was treated or disposed of. Our staff will audit your form and send you an invoice by May 15th based on the audited amount. Your fees will then be due by June 15th.

Hazardous Waste Remedial Action Fees are outlined in Rule 0400-15-01 and charged as follows:

2,645 - 7,334 lbs (1,200 - 3,326 kg) = $865.00

7,335 - 237,418 lbs (3,327 - 107,692 kg) = $0.117935 per lb. ($0.26 per kg)

>237,418 lbs (>107,693 kg) = $28,500.00

Off-Site Shipping Amount of hazardous waste shipped off-site during the previous calendar year $0.0209437 per kg ($19.00 per ton)
Off-Site Shipping of Hazardous Waste Water Amount of hazardous waste water shipped off during the previous calendar year.  $0.01047185 per kg ($9.50 per ton)

Hazardous waste generators should receive form RF-FDS each December. You can also download a copy of form RF-FDS.
