  • January 2, 2020
    • The Division of Air Pollution Control has filed a Notice of Rulemaking Hearing with the Tennessee Secretary of State’s office. The Tennessee Department of Environment and Conservation, Division of Air Pollution Control proposes to amend Chapter 1200-03-29 of the Air Pollution Control Regulations, Light Duty Motor Vehicle Inspection and Maintenance.  The proposed changes revise the Tennessee light duty motor vehicle emissions inspection and maintenance programs applicability to meet the requirements of  Public Chapter No. 953, signed into law on May 15, 2018.  Public Chapter 953 requires the elimination of the vehicle emissions testing program 120 days after Federal Environmental Protection Agency (EPA) approval of 110(l) Noninterference Demonstration reports on the air quality impacts of removal of the vehicle inspection programs from 5 Middle Tennessee (Davidson, Sumner, Rutherford, Williamson and Wilson)  and Hamilton County, Tennessee.  These reports will be submitted to the EPA pending Tennessee Air Pollution Control Board Approval.   

      A red-lined version of the proposed rule is available to assist with the public’s review. Comments must be received by 4:30 PM February 13, 2020 to be considered part of the official record. Please refer to the Public Hearing Notice for time and location of the hearing, and details on the written comment process.

    • The  Division of Air Pollution Control has filed a Notice of Hearing  to consider a proposed change to the State Implementation Plan (SIP) under the authority of Tennessee Code Annotated, Section  68-201-105.  The public hearing has been called to consider the Clean Air Act Section 110(l) Noninterference Demonstration for removal of the Vehicle Inspection and Maintenance program for Davidson, Williamson,  Wilson, Sumner and Rutherford Counties in Middle Tennessee from the State Implementation Plan. Public Chapter No. 953, signed into law on May 15, 2018, requires the elimination of the Inspection & Maintenance program 120 days after final EPA approval of the 110(l) report.The Public Hearing Notice and the Noninterference Demonstration for the Removal of the Inspection and Maintenance Program in Middle Tennessee are provided to assist in public review.  Comments are due by November 19, 2019.   • The Division of Air Pollution Control has filed a Notice of Rulemaking Hearing with the Tennessee Secretary of State’s office. The Tennessee Department of Environment and Conservation, Division of Air Pollution Control proposes to amend Chapter 1200-03-26 of the Air Pollution Control Regulations, Administrative Fees Schedule. Proposed changes include revising the Tennessee Visible Emission Evaluation Course Fees, revising the annual fees for facilities subject to Title V permitting (primarily major sources of air pollution), correction of grammatical and typographical errors, removal of obsolete text, and additional clarifications to the rules. A redlined version of the proposed rule is available to assist with the public’s review. Comments must be received by 4:30 PM November 25, 2019 to be considered part of the official record.

  • The Division of Air Pollution Control has filed a Notice of Hearing  to consider a proposed change to the State Implementation Plan (SIP) under the authority of Tennessee Code Annotated, Section 68-201-105. This hearing is to consider the Limited Maintenance Plan (LMP) providing Tennessee’s maintenance plan for the remainder of the 20-year maintenance period for the 1997-8 hour ozone NAAQS in the remaining Knoxville 1997 8-hour ozone area. This plan sets forth air quality and emissions data that assures the area will continue to maintain the 1997 8-hour ozone NAAQS. Further, in the unlikely event the area does violate the 1997 8-hour ozone NAAQS, this document describes a plan to promptly address the NAAQS violation. The final version of this document will be submitted to the EPA to meet Tennessee’s CAA section 175A(b) obligations for this area.

    The Public Hearing Notice, and the Limited Maintenance Plan Report are provided to assist in public review.  Comments are due by November 18, 2019.
