Employer/ Employee Awareness Program
As part of its efforts to train employers and employees on their rights and responsibilities is a workers' compensation claim, the Bureau has developed a public awareness program. If you would like to request a representative of the Bureau to speak to your group, please submit your request by email to WC.Info@tn.gov.
Claims handling is more efficiently process, disputes are reduced and injured employees have a greater likelihood of returning to work and with better results when all parties understand their duties and obligations. it is everyone's duty to act responsibly. The Bureau's speaker can help train your audience what that entails and show how doing so will save employers money and produce better outcomes for injured employers.
Drug Free Workplace Awareness Program
As part of its efforts to help ensure safe workplaces, the Bureau has developed a public awareness program. The Tennessee Drug Free Workplace Program is a voluntary program designed to add value for Tennessee employers by promoting drug-and-alcohol-free workplaces. Employers whose workers are not impaired by drugs and alcohol have safer worksites and can operate on an enhanced competitive position free from the costs, delays, and tragedies caused by substance abuse. The program ended Fiscal Year 2015/16 with 3,523 active participants, which provided safer worksites for more than 325,000 Tennessee employees.
The focus on safety is the underlying value of the program along with these entitled benefits to active participants:
- A 5 % premium credit on their workers’ compensation insurance policy;
- The discharge of discipline of an employee, or the employer’s Drug-Free Workplace Program, will be considered done for “cause”;
- A shift in the burden of proof required to award workers’ compensation benefits to the employee, if an employee suffers a workplace injury and receives a positive confirmed post-accident drug test for illegal use of drugs or alcohol or refuses to submit to a post-accident drug or alcohol test.
The Bureau’s speaker can help educate employers on the benefits of implementing a drug-free program in the workplace and the additional benefits of joining the Drug Free Workplace Program. Fraud Awareness Program
As part of its efforts to eliminate Workers' Compensation fraud, the Bureau has developed a public awareness program. If you would like to request a representative of the Bureau to speak to your group, please submit your request by email to WC.Info@tn.gov.
Any party involved in a claim that knowingly and intentionally defrauds another party of property or monetary gain has committed a fraudulent insurance act.
The Bureau will report any findings of fraud to the appropriate law enforcement agency
Workers’ Compensation fraud can also occur when an employer is not paying for workers’ compensation insurance coverage or is treating workers as independent contractors when legally they should be employees. The department is charged with investigating allegations of fraud committed by any party to the fraud including attorneys, employees, employers, health care providers, and insurance carriers.
Through its investigations, audits, and reports, Workers’ Compensation focuses on reducing costs to the workers' compensation system by eliminating fraud and by acting to improve the efficiency and effectiveness of the workers' compensation system.
