The Tennessee Department of Environment and Conservation (TDEC) Division of Land Protection (DLP) has tentatively decided to reissue a hazardous waste post-closure permit to Olin Corporation. The Olin Corporation (EPA ID TND003337292) is located in Bradley County at 1186 Lower River Road, Charleston, TN 37310. TDEC invites the public to submit comments on this proposal during a 45-day comment period ending on Tuesday, July 21, 2026. A public hearing is scheduled for Monday, July 6, 2026, to provide an additional opportunity for public comments.

The facility submitted their Part A and Part B renewal applications on March 18, 2025, thus enabling the facility to continue to operate under the current permit until the new permit is issued or denied. As part of the pre-application process, Olin Corporation conducted a pre-application public meeting on March 17, 2025, as announced in the February 15, 2025, edition of the Cleveland Daily Banner newspaper and a radio announcement on February 15, 2025, WALI Alive 96.9 and WENR 1090AM. There were two attendees from the public at the March 17, 2025, meeting. Verbal comments were received during the Public Meeting. No written comments were received during the comment period.

The draft renewal permit will allow the facility to continue post-closure care, monitoring, and maintenance of a closed surface impoundment. The post-closure care requirements include all the provisions necessary for maintaining the vegetated cap and the surrounding security fence. The draft permit also requires groundwater sampling and analysis of the monitoring wells installed around the unit. Regular inspections and repairs are required to ensure that the cap, fence, and monitoring wells are maintained in good condition. The facility is required to report annually on all sampling, maintenance, and inspection activities performed at the site. The draft renewal permit provides information on all Solid Waste Management Units (SWMUs) and Areas of Concern (AOCs) at the facility, including any previous or ongoing investigations or corrective actions for any releases of hazardous wastes or hazardous constituents. The conditions of this permit will require that any future and existing SWMUs or AOCs be evaluated for potential releases and remediation, as necessary.

Based on the review of the application and as authorized pursuant to Tennessee Rule 0400-12- 01-.07(7), DLP has determined the application to be complete and has prepared a draft permit. The DLP proposes to issue the permit under the authority of the Tennessee Hazardous Waste Management Act of 1977, as amended, Tennessee Code Annotated, Section 68-212-101 et seq., and Rule Chapter 0400-12-01, Hazardous Waste Management. In accordance with Rule 0400-12- 01-.07(7)(e), this notice requires a 45-day comment period, beginning on the date of this publication. A fact sheet has been prepared that provides additional information about the site and the proposed permit. Pending consideration of any contrary information received, it is the present intent of the DLP to issue this permit. If issued, the permit would be effective for ten years.

A public hearing will be held on Monday, July 6, 2026, at the Cleveland Bradley County Public Library located at 795 Church ST NE, Cleveland, TN 37311, as well as via video teleconference. Information on how to join online is provided below. An information session will be held from 6:30 p.m. to 7:00 p.m. EDT for the public to inspect and discuss the permit application, draft permit, fact sheet, plans, and other materials with representatives of the Olin Corporations and the DLP. The formal hearing will begin at 7:00 p.m., EDT with a presentation from the DLP on the tentative decision to issue the permit followed by a presentation by Olin Corporation describing the activities at the facility. After the presentations, the DLP will receive oral comments on the draft permit from the public that will be recorded. The public may submit written comments at the meeting.

After considering all comments, the DLP will make a final decision to either issue or deny the permit. Notice will be given to the applicant and each person who has submitted written comments or requested notice of the final decision. At the time a final decision is issued, a Response to Comments document addressing all significant input received on the draft permit will be made available to the public. The final decision shall become effective upon signing by the Director of the DLP.
