About

The proposed amendments to the rules of the Court of Workers’ Compensation Claims and Alternative Dispute Resolution contain both revisions to existing rules and several new rules for clarity and to assist with the efficient handling of cases.  A few changes include:

  •  Rule 0800-02-21-.15 is revised to provide that letters or written statements from physicians regarding the reasonableness and necessity of treatment and medical bills are admissible at an expedited hearing and need not be in affidavit form.
  • The compensation hearing rule is amended to provide that affidavits or Rule 72 declarations are not admissible absent a stipulation of the parties or by leave of Court.
  • The discovery rule, 0800-02-21.17(b), includes new limits for requests for production of documents and requests for admissions in addition to interrogatories.
  • A new rule concerning appeals will clarify that a party may appeal an order of a Workers’ Compensation Judge by filing a notice of appeal, on a form approved by the Administrator, with the clerk of the Court of Workers’ Compensation Claims. However, an appeal to the Tennessee Supreme Court must comply with the Tennessee Rules of Appellate Procedure.
