Funding Requests and Beneficiary Expenditures

Under Section 5.2 of the Volkswagen Diesel Settlement Environmental Mitigation Trust (VW Settlement EMT) State Trust Agreement (archive), Beneficiaries are responsible for submitting requests for Eligible Mitigation Action (EMA) funding by filing with the Trustee a Beneficiary Eligible Mitigation Action Certification form (i.e., funding request). In its Certification for Beneficiary Status (archive), the State of Tennessee noted that it would make available on its VW Settlement webpage all funding requests and associated documentation submitted to the Trustee. The State also noted that it would summarize details regarding the expenditure of Trust Funds by the Beneficiary and maintain such information on its VW Settlement webpage.

Note: Each EMA category’s totals for “Initial Eligible Project Funds,” “Initial Eligible Administrative Expenditures Reserve,” and “Anticipated Total EMA Funding” are established in the State of Tennessee’s current Beneficiary Mitigation Plan (BMP) (archive). The State Trust Agreement provides that Beneficiaries have the flexibility to adjust their goals and specific spending plans at their own discretion; thus, should the State elect to make adjustments, these totals may be updated at the time of BMP modification and publication.
