Regulatory Requirements of Asbestos Program
The current Asebestos regulatory requirement is Tennessee Rule Chapter 0400-13-02, which became effective on May 20, 2025, replacing Tennessee Rule Chapter 1200-01-20.
The amended Rule establishes the procedures and requirements for accrediting training programs, training courses, firms, and five professional disciplines authorized to conduct asbestos activities. It specifies the asbestos-related functions each discipline may perform and mandates that only Tennessee-accredited individuals may conduct asbestos activities in schools or in public and commercial buildings within the state. These activities include developing school management plans, preparing project designs, carrying out response actions, performing inspections, and collecting clearance air samples.
The Rule’s purpose is to ensure that all individuals are properly trained and accredited, and that training programs meet defined curriculum standards for each asbestos discipline. It introduces a three-year accreditation requirement for firms, permits dual accreditation as an asbestos inspector/management planner, and authorizes accredited programs to provide online refresher courses under certain limitations. The amended Rule also establishes new accreditation fees for individuals, firms, and training courses, and outlines penalties for non-compliance.

Asbestos Accreditation Requirements
The Asbestos Rule transitioned to Tennessee Rule Chapter 0400-13-02, effective May 20, 2025. Tennessee Rule Chapter 12-01-02 Asbestos Requirements originally became effective June 23, 2009, for firms, asbestos professionals, and training providers in Tennessee.
The Asbestos Accreditation Requirements are applicable to all persons and firms who perform asbestos activities in schools or public and commercial buildings, as well as training providers who offer asbestos training courses to individuals who have or seek accreditation in Tennessee.
These Rules stipulate that only accredited persons shall perform asbestos activities inclusive of developing management plans in schools, project designs, conducting response actions, inspections, and collecting clearance air samples to confirm the completion of a response action involving friable and non-friable asbestos-containing materials and asbestos-containing building materials in schools or public and commercial buildings.

Online Electronic Submission of Asbestos Accreditation Applications
Drive to Paperless SubmissionsFirms, training providers, and individuals will have another option for submitting applications for asbestos accreditation, course notifications, and student rosters. On February 24, 2025, the Tennessee Department of Environment and Conservation’s Toxic Substances Program will open the MyTDEC Forms online internet portal to receive asbestos accreditation applications for individuals, firms, training provider courses, and payments. Each accredited individual, firm, LEA agency, and training provider “MUST” register for themselves.Training providers will use the online system to submit course notifications and student rosters as required by Rule 1200-01-20-02(16)(i) submit course notification 20 days before the commencement of the first day of instructional training; (ii) submit student roster no later than 10 days after the conclusion of the training course for all types of approved courses that were conducted.
Firms, training providers, and individuals can submit applications for asbestos accreditation, course notifications, student rosters, and payments as of February 24, 2025. Individuals, firms, LEA agencies, and training providers must complete separate registrations.
Due to federal identity compliance rules, another person cannot register for you.
Training providers will use the online system to submit course notifications and student rosters as required by Rule 1200-01-20-02(16)(i) twenty (20) days before the commencement of the first day of instructional training; (ii) submit student roster no later than ten (10) days after the conclusion of the training course for all approved courses that were conducted.
Each user must create an account with a unique user ID (unique email), password, and security questions.
Step-by-step instructions for registering a new account at the MyTDEC Forms portal begin by clicking the “Create Account” button at the top of the page.
Follow the instructions to register a new account.
Next, you will answer 5 security questions. Save your password and the questions and answers. You will need this information at various times using your registered account.
Once you have registered your account, you will be ready to use the system to complete and pay for applications online.

The Asbestos Hazard Emergency Response Act (AHERA)
AHERA is a federal statute enacted in 1986 requiring local education agencies (LEAs) to inspect their schools for asbestos-containing building materials and to prepare management plans to assist in the prevention or reduction of asbestos hazards.
The Toxic Substances Program conducts compliance monitoring inspections at LEAs throughout the State of Tennessee.
