This Office was recently asked what fundraising restrictions, if any, would exist for General Assembly members, caucus political campaign committees (“PACs”) and leadership PACs (PACs established or controlled by a member of the General Assembly) under Tennessee’s campaign finance statutes if the General Assembly were to meet in a special session in August 2020. T.C.A. § 2-10-310(a)(1) & (b) specifically prohibits fundraising by General Assembly members, as well as caucus and leadership PACs, “from the convening of the general assembly in any extraordinary (i.e. special) session through the conclusion of such extraordinary session.” Furthermore, per the restriction on employers of lobbyists and PACs controlled by employers of lobbyists under T.C.A. 3-6-304(i), under this statute those entities cannot make contributions to “a candidate for the office of governor or member of the general assembly during any regular annual session or any extraordinary session of the general assembly.” Please contact our Office if you have any further questions regarding this matter.
