Assistant Attorney General - Financial Division

 

The Tennessee Attorney General and Reporter represents all State executives, officials, departments, boards, agencies, and commissions in matters arising from their public duties. Such representation includes participation in litigation, transactional matters, and giving day-to-day legal advice to a wide variety of State entities. The Attorney General's Office employs approximately 200 attorneys organized into 22 regular divisions within 6 sections.

About the Financial Division:

The Financial Division is housed within the Financial and Regulatory Section of the Attorney General’s Office. This Division provides legal services for much of the State’s business-related activities, representing numerous agencies that deal with issues of government financing, procurement, taxation, banking, economic development, legal gambling, and insurance and securities regulation. Division clients include the Department of Revenue, the Department of Commerce and Insurance, the Department of Treasury, the Comptroller of the Treasury, the Department of Economic and Community Development, the Department of Finance and Administration, the Department of Financial Institutions, the State Building Commission, the Department of General Services—including STREAM and the Central Procurement Office—the Office of the State Architect, the Tennessee Consolidated Retirement System, and the Sports Wagering Council.

Job Overview:

The Financial Division is seeking an organized and detail-oriented attorney to focus on contracting and procurement for the State. This position will require an attorney who is adept at learning and synthesizing relevant governing law, and who is able to quickly apply multiple bodies of applicable law to fact-specific legal matters. That attorney will regularly perform the following duties, among other tasks as needed.

  • Provide legal advice to State agencies, entities, officials, and employees concerning state services, contracts, transactional work, capital projects, and the procurement process.
  • Review contracts pertaining to matters largely governing real estate and construction.
  • Handle bid protest appeals in state courts.
  • Serve as a primary counsel to the following State entities: State Building Commission, Office of the State Architect, Department of General Services’ (DGS), Real Estate and Asset Management (STREAM), and DGS’s Central Procurement Office (CPO).

The ideal candidate will have the following qualifications:

·         Juris Doctorate and Tennessee bar admission or ability to apply for admission without examination.

·         Strong understanding of transactions and contract review.

·         Experience with business processes including secured lending.

·         At least 4 to 8 years of practicing law.

·         Real estate law experience and established transactional legal practice; experience in litigation is a plus.

·         Experience working with government procurement and bid protests.

·         The ability to work as part of a team and to explain legal issues to non-attorneys.
