NASHVILLE - The Tennessee Board of Accountancy has placed Hixson resident Herbert A. Miller Jr.’s license on probation for two years, in relation to a penalty enacted by the U.S. Internal Revenue Service for filing his personal taxes late.

At a recent meeting, the Accountancy Board voted to place Miller’s license on probation for two years. He signed a consent order and paid a civil penalty of $1,500. The order was finalized earlier this month. His probationary period runs from August 3, 2010, to August 3, 2012. Miller holds CPA license 3047.

Miller admitted to the IRS in an October 2008 consent agreement that he had filed personal tax returns after the due date. The forms involved were three 1040 forms and seven 941 forms. That agreement resulted in the suspension of his right to practice before the IRS for two years, with an effective date of October 21, 2008. After completing its case, the IRS alerted the Tennessee Accountancy Board by filing a complaint against him.

The Board of Accountancy is one of the regulatory boards within the Department of Commerce and Insurance, which works to protect consumers while ensuring fair competition for industries and professionals who do business in Tennessee. www.tn.gov/commerce/
