Notice of Effective Date for New Rules for
Tennessee Department of Commerce and Insurance Regulatory Boards
Burial Services Program

Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.

The Tennessee Department of Commerce and Insurance Regulatory Boards Division Burial Services Program approved these rules at a rulemaking hearing on April 30, 2026. These rules were filed with the Secretary of State on September 25, 2026, and will become effective on December 24, 2026. These rules have been filed as Rulemaking Hearing Rules and will be promulgated (90) days from the filing date.

The rules make several administrative updates to the Burial Services program including removal of outdated links or URLs, general clean up for both the CPI-U annual averages and civil penalty layouts, removal of outdated or inapplicable fees, and removal of paper size requirements. Likewise, the rules also update pre-need rules to comply with a recent statutory change requiring that funds received from pre-need to be deposited within fifteen (15) days rather than thirty (30). The pre-need rules also update the civil penalty floor from $25.00 to $250.00, and clean up of the civil penalty layout.
