Consumer Fireworks Executive Signature Questions
Tennessee law requires that all permit applications for the retail sale of consumer fireworks be signed by the chief executive officer of the county or municipality in which the fireworks are to be sold. To fulfill the requirement of state law, the current practice requires that applicants contact the office of chief executive officer of the county or municipality in which the fireworks are to be sold in order to obtain his/her signature on the application that must be returned to the Department of Commerce and Insurance.
By answering the questions listed below and checking the appropriate box, the information provided about your jurisdiction will be made public so that applicants can determine any restrictions on the sale of consumer fireworks in your jurisdiction. If you designate that the retail sales of consumer fireworks are allowed in your jurisdiction and you elect to make that information public to potential applicants, an applicant will not be required to obtain your signature for approval of the permit application. It’s important to note that applicants will still need to meet any local permitting requirements.
If you choose to opt-out from this option, your jurisdiction will be listed as a jurisdiction which did not provide information regarding the retail sale of consumer fireworks. Permit applicants for the retail sale of consumer fireworks within your jurisdiction will continue to contact your office in order to obtain your signature before their application may be considered by the Department. In other words, if you choose to opt-out, the process for approving permits for the retail sale of consumer fireworks within your jurisdiction will remain the same.
If the Department does not receive your response to these questions by Friday, October 11, 2019, your jurisdiction will remain under the previously selected option for your jurisdiction. Also, if you do not wish to make changes to your previous selection then there is no need to resubmit these questions.
