The Tennessee Department of Health (TDH) is responsible for on-going active state supervision of mergers granted under a Certificate of Public Advantage (COPA), according to Permanent Rules 1200-38-01-.01 et seq. , effective January 4, 2016, implement TCA Sections 68-11-1301 – 68-11-1309, which govern the COPA process.

Tennessee’s active supervision structure is laid out in the Terms of Certification executed by TDH and the two health systems which merged to become Ballad Health: MSHA and Wellmont Health System.  One part of the active supervision structure is a Local Advisory Council (LAC) intended to facilitate input from residents of the Geographic Service Area. The Terms of Certification require that the LAC be comprised of 8-10 community leaders and that the LAC be supported by the TDH Division of Health Planning.

As outlined in the Terms of Certification, the LAC’s responsibilities include:

  • Recommending to the TDH how funds in the Population Health Initiatives Fund should be spent;
  • In coordination with the TDH, hosting an annual public hearing to allow a formal process for the public to comment on the Annual Reports from Ballad Health and the COPA Compliance Office and the ongoing performance of Ballad Health; and
  • Publishing the Local Advisory Council Annual Report that incorporates community feedback for review by the COPA Monitor and TDH after the annual public hearing.

How to Provide Feedback to the Local Advisory Council

The general public is encouraged to provide feedback on the progress and impact of the Ballad Health merger on the region.

Please be aware that any comments or information you submit or share with the Local Advisory Council through the Department will be considered a public record.

  • Letters from individuals will not be posted to the website but may be considered public record. This might mean that the Department will give copies of these comments to news agencies upon request.
  • Upon a request for information, it will be the Department's policy to share the name of the individual submitting a comment and to redact other personally identifying information, including contact information, before releasing comments from individuals.
