Opportunity for Public Comment – Heightened Scrutiny – Approved Provider Settings: The public comment period began June 15, 2018 and closed July 15, 2018.

The Statewide Transition Plan has been revised to include the list of provider settings TennCare has determined to be either fully compliant, or settings that TennCare believes will be compliant upon full implementation of an approved transition plan. The plan has also been updated to include a description of the Advocacy Review Committee and public comment processes, as well as the State’s response to all comments submitted.

TennCare is seeking public comment as part of its approved Statewide Transition Plan for coming into compliance with the Home and Community-Based Services Settings Rule. After conducting Heightened Scrutiny reviews beginning in March 2016 of Medicaid-reimbursed Adult Critical Care Homes, Assisted Care Living Facilities, Adult Day Centers, Facility-Based Day Centers, Residential Habilitation with More than Four Residents, and Residential Habilitation and Supported Living in Close Proximity, the State has identified provider settings that have overcome the institutional presumption and will be submitted to the Centers for Medicare and Medicaid Services (CMS) for further review, either because the setting was in compliance after review or the setting successfully submitted a TennCare-approved transition plan to come into compliance. The packet TennCare submits to CMS for each setting will be revised to include a summary of feedback received from the Advocacy Review Committee and any public comment provided on each setting.

The attached document includes the list of provider settings TennCare has determined to be either fully compliant, or settings that TennCare believes will be compliant upon full implementation of an approved transition plan, listed by setting type.
