PUBLIC NOTICE REGARDING SECTION 4(F) DE MINIMIS DETERMINATION AND NOTICE OF PUBLIC COMMENT PERIOD

In compliance with Section 4(f) of the U.S. Department of Transportation Act of 1966 (49 U.S.C. § 303), hereinafter referred to as “Section 4(f),” and its implementing regulations codified at 23 C.F.R. Part 774, the Federal Highway Administration (FHWA) in cooperation with the Tennessee Department of Transportation (TDOT) and the city of Collegedale is providing public notice of its proposal to make a    De Minimis impact finding under Section 4(f) regarding the effects of the proposed SR-317 project, from SR-321 (Ooltewah-Ringgold Road) to east of Layton Lane (PIN 112524.01) on a portion of the Wolftever Creek Greenway, and to provide the opportunity for public review and comment on this proposed determination.


The project is located in the city of Collegedale, Hamilton County, Tennessee.  The typical section for the SR-317 improvements includes a five-lane roadway with two 12-foot travel lanes in each direction, a     12-foot center turn lane, and four-foot shoulders on each side. The four-foot shoulders will also serve as bike lanes. Two feet of curb and gutter will separate the shoulders/bike lanes from a multi-use path. The multi-use path will include five feet of concrete sidewalk separated by three feet of sod on one-side and four feet of sod on the other.  All improvements are expected to occur within 96 feet of right-of-way.  


Pursuant to 23 C.F.R. § 774.5(b)(2), notice is hereby provided of the proposed De Minimis finding determination. The proposed De Minimis impact finding is based on coordination with the officials with jurisdiction. The official with jurisdiction is the city of Collegedale, which owns and administers the affected portion of the property protected by Section 4(f). The officials have been notified of FHWA’s intent to make a De Minimis impact finding. Should the city of Collegedale concur, FHWA will issue a finding of De Minimis impact. 


TDOT will be present at the city of Collegedale’s Commission Meeting on August 1, 2016 at 6 p.m. at 4910 Swinyar Drive, Collegedale, Tennessee 37363, in the City Hall’s Municipal Room.  TDOT representatives will be on-hand to give a short presentation on the Section 4(f) process as well to further explain the Section 4(f) De Minimis determination which TDOT is requesting.  Representatives from TDOT will also be present to address questions pertaining to the proposed Section 4(f) De minimis determination for the Wolftever Creek Greenway.  


Comments regarding the proposed Section 4(f) De Minimis impact finding may be submitted to TDOT in writing during the 21-day comment period; the comment deadline is August 22, 2016. A court reporter will be available to receive oral statements to be included in the project’s transcript. In addition, comment sheets are available for those who prefer to make written statements.  Written statements and other exhibits to be included in the project transcript may be submitted within 21 days after the Commission Meeting date to the following address:
