AN ACT to amend Tennessee Code Annotated, Section 7-82-307, relative to utility districts located entirely within any county having a population of not less than twenty-seven thousand nine hundred (27,900) nor more than twenty-eight thousand (28,000), according to the 1980 Federal Census or any subsequent Federal Census.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section 7-82-307(t)(4), is amended by deleting the second sentence and by substituting instead the following:
After the effective date of this act, to be eligible for election to the Board of Commissioners a person must reside in the district and must have graduated from high school; provided, however, any member serving on the board on the effective date of this act shall be eligible for re-election notwithstanding his or her lack of a high school diploma. If, at the nominating meeting, only one (1) person is nominated to fill a vacancy on the board, then the current members of the board may elect such nominee by acclamation and, thereby, obviate the election proceedings otherwise required pursuant to subdivision (5) to fill such vacancy.
SECTION 2. This act shall take effect upon becoming a law, the public welfare requiring it.
