AN ACT To amend Tennessee Code Annotated, Title 62, Chapter 35, relative to the Private Protective Services Licensing and Regulatory Act.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 62-35-103(a), is amended by adding the following new subdivision:

( ) A person who is compensated by a resort area owner or management company and who has received a commission from the chief law enforcement officer of the appropriate governmental entity. Within one (1) year of being so employed, such person shall have completed a training program approved by the commissioner. Such program shall be approved only if all training requirements and the qualifications for the employee are equivalent to or superior to those required for a law enforcement officer under the standards established by the Peace Officer Standards and Training Commission for law enforcement officers. The commissioner shall approve the exemption established by this subsection for each employee utilizing such exemption;

SECTION 2. This act shall take effect upon becoming a law, the public welfare requiring it and shall be retroactive to October 31, 1996.
