AN ACT To amend Tennessee Code Annotated, Section 5-21-126(b)(1); Section 9-21-209; Section 57-4-103(a)(2)(A) and Section 67-6-706(a)(2), relative to the timing of elections on questions.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 9-21-209, is amended by adding the following sentence after the first sentence of the section:

Such election shall be held as an election on a question by the county election commission pursuant to Tennessee Code Annotated, Section 2-3-204.

SECTION 2. Tennessee Code Annotated, Section 57-4-103(a)(2)(A), is amended by inserting the language and punctuation "except for referenda scheduled to be held with the regular November general election which shall be held pursuant to Tennessee Code Annotated, Section 2-3-204," between the language and punctuation "held" and "the".

SECTION 3. Tennessee Code Annotated, Section 67-6-706(a), is amended by deleting subdivision (2) in its entirety and by substituting instead the following:

The county election commission shall hold an election on the question pursuant to Tennessee Code Annotated, Section 2-3-204, providing options to vote "FOR" or "AGAINST" the ordinance or resolution, after the receipt of a certified copy of such ordinance or resolution, and a majority vote of those voting in the election shall determine whether the ordinance or resolution is to be operative.

SECTION 4. Tennessee Code Annotated, Section 5-21-126(b)(1), is amended by deleting the language "within thirty (30) days" and substituting instead the language "on the question pursuant to Tennessee Code Annotated, Section 2-3-204".

SECTION 5. This act shall take effect upon becoming a law, the public welfare requiring it.
