Alien Labor Certification

Tennessee Employers interested in hiring foreign workers for Temporary H2B openings can file an Application for Alien Labor Certifications, ETA 9142, on line at http://www.foreignlaborcert.doleta.gov/.

Tennessee Employers interested in hiring foreign workers under Permanent Residency (Green Card) for certain employment based immigrant visas can process their applications through the “PERM” Program.  For information regarding the “PERM” http://www.foreignlaborcert.doleta.gov/.

Prevailing Wage requests for Alien Labor can be processed both by fax or email.  Click on the prevailing wage request PDF file link, complete the requested information and email it to the email address indicated at the bottom of the form.  The request will be processed and returned via email or fax which ever is applicable.  The average processing time for Alien Labor Prevailing Wage Requests is approximately two weeks.

Job Orders for PERM  and H2B applications can be posted on-line at http://ecmats.state.tn.us.  Employers interested in hiring foreign workers for a permanent residency visa or H2B may register and post the opening with ALC office #620.  The ALC Unit will review all posted orders an approve, if posting regulations are met.  Employers and/or their agent will receive notice via email when the job order has been posted.

AGRICULTURAL RECRUITMENT PROGRAM (H-2A PROGRAM)

Agricultural employers can receive assistance in obtaining farm workers through the H2A program.  Employers must show that there are no local workers available for the job.  Applications are reviewed to determine whether prevailing hourly wages, working conditions, and housing and transportation arrangements have an adverse effect on domestic workers.

Information for applying for H2A workers is provided by your local Department of Labor and Workforce Development office.

The department provides the following services to agricultural employers:

  • Processing of agricultural clearance orders
  • Technical assistance on farm labor matters
  • Housing inspection for agricultural clearance orders
  • Agricultural wage information
  • Technical assistance on federal and state regulations governing housing inspections
  • Opportunity for participation in the Workforce Employer Outreach Committee
