All tank owners in Tennessee were mailed a copy of the Division's latest tank owner assistance aid, a CD called Compliance Tool Box. Compliance Tool Box is a collection of documents and references all designed to help tank owners learn about and achieve compliance with the Tennessee Underground Storage Tank rules and regulations. On November 15, 2006 EPA issued final Guidelines on Secondary Containment as required by the Energy Policy Act of 2005. These Guidelines mandate that states choose between installing secondary containment or requiring financial responsibility on manufacturers and installers as an additional means of protecting groundwater. Tennessee, along with the majority of other states, has chosen to require secondary containment. The Guidelines contain an implementation date of February 8, 2007 which has led to some confusion among tank manufacturers and installers. The Division of Underground Storage Tanks also issued a letter which explains that the February 8, 2007 date is not a federal deadline for secondary containment, and that the Division will be promulgating state regulations which will contain a deadline for implementation of secondary containment.

On August 8, 2005 President Bush signed the Energy Policy Act of 2005. Title XV, Subtitle B of this sweeping legislation is known as the Underground Storage Tank Compliance Act of 2005. This is the most significant federal Underground Storage Tank legislation since the passage of the federal UST rules September 22, 1988. The UST provisions are on pages 1563-1607 of the Act.

Effective December 1, 2004, the Division implemented a new Risk Based Corrective Action (RBCA) Process. The TN-RBCA Process is a revision of previous processes and provides several advantages.
The facts are that the demands upon the fund have continued to rise, due to a number of factors, while the revenue streams which are the source of fund dollars have remained relatively constant. Due to the resulting increased need to be better stewards of the fund, the Division of Underground Storage Tanks (the Division) is re-evaluating many of its existing practices.
