Permit Fees

In 2016, the Tennessee Division of Air Pollution Control (APC) initiated a stakeholder process to assist in the development of revisions to our Title V fee regulations.  This email is to announce continuation of that process with a series of webinars and face-to-face meetings to be held over the next several weeks.

Title V permit fees are largely based on the amount of actual and allowed emissions from Title V sources.  Due to a number of factors, including tighter air quality regulations, retirement of large emitters of air pollutants, and the general trend towards cleaner-burning fuels, actual and allowable emissions from sources in Tennessee have dropped significantly in recent years and will continue to do so for the next couple of years.  Unfortunately, this drop in emissions does not equate to a similar reduction in workload required of the Division.  As a result, APC is projecting a shortage in the revenue needed to fund Tennessee’s Title V program starting in fiscal year 2019.  Both federal and state statutes and regulations require that the state’s Title V program be funded by Title V facilities.  An increase in revenue is needed in the Title V fees that sources pay beginning in 2019.  Therefore, the Division of Air Pollution Control is soliciting your input on how a revised Title V fee system should be structured.

The schedule for the stakeholder process is as follows:

Kickoff Webinars – The purpose of the kickoff webinars is to provide background information to the stakeholders, explain the increase in revenue needed to satisfy expected Title V expenses, and to provide a tool that stakeholders can use to evaluate fee structure options.  Both webinars will cover the same material, so you only need to participate in one.  These webinars are scheduled for Thursday, May 11th at 2:00 pm Central and Monday, May 15th at 2:00 pm Central.  A WebEx invitation from Air Pollution Control will be sent to you in a separate email prior to the webinars that will provide instructions for joining the meetings.  Materials from these webinars will be posted at the website indicated below.

Face-to-Face Meetings – We are scheduling two face-to-face meetings for APC to receive feedback and suggestions from stakeholders on how the Title V fee structure should be revised to meet budgetary needs.  A short amount of background information will be repeated from the kickoff meetings, but the main purpose of the face-to-face meetings is for APC to hear from the stakeholders.  We are scheduling meetings in two different locations to reduce travel time for some stakeholders and provide scheduling options.  Since APC will primarily be receiving input from stakeholders at this meeting, it is not necessary to attend both meetings.  The first face-to-face meeting will be May 24, 2017 at 1:00 PM at the Tennessee Bureau of Investigation office located at 901 R.S. Gass Blvd., Nashville, TN, room 2.250. The second meeting will be June 1, 2017 at 1:00 PM at the Tennessee Department of Environment and Conservation Chattanooga Environmental Field Office, which is located at 1301 Riverfront Parkway, Chattanooga, TN. 

Second Webinar – The purpose of this webinar is for APC to present a proposed option based on input from stakeholders.  APC will present and answer questions about our proposal.  Feedback on APC’s proposal will be requested to be submitted by June 30, 2017.  This webinar is scheduled for Friday, June 16th, at 1:00 pm Central.  A WebEx invitation from Air Pollution Control will be sent to you in a separate email prior to the webinar will provide instructions for joining the meeting.  Materials from this webinar will be posted at the website indicated below.
