Non-Manufacturing Non-Resident Seller License

Overview

A non-manufacturing non-resident seller’s permit authorizes a person to contract with a TABC licensed manufacturer for the production of alcoholic beverages on the person’s behalf or to license a trademark or trade name to a manufacturer. Once the alcoholic beverages are made by the TABC licensed manufacturer they become the property of the non-manufacturing non-resident seller permitee who can store the alcoholic beverages at an approved location, sell the alcoholic beverages to TABC licensed wholesalers, and market the alcoholic beverages pursuant to state law.

The below list of requirements may not be an exhaustive list of requirements and additional documents or information may be requested as needed. In particular, there will be several additional requirements if an applicant wishes to take physical possession of, and store, the alcoholic beverages, including an additional license fee. Please inform the Commission if you intend to take physical possession of, and store, the alcoholic beverages.

Application Requirement Checklist
  1. Copy of all contracts between applicant and any Tennessee Manufacturer
  2. TABC Inspection and Acknowledgement of TABC Rules and Regulations
  3. Sales and Use Tax Certificate issued by Dept. of Revenue
  4. A completed questionnaire for each person who has an interest in the applicant.
  5. A completed Declaration of Citizenship for each person who has an interest in the applicant.
  6. If Corporation, LLC, or other business entity, then:
    • Copy of organizational documents (i.e. corporate charter, operating agreement, etc.)
    • List of Shareholders, members, officers, etc. (A form for this can be found on the Forms page)
    • Certificate of Existence
  7. A license fee of:
    • $150 if applicant will be selling fewer than 100 cases of alcoholic beverages in this state
    • $250 if applicant will be selling at least 100 cases of alcoholic beverages in this state
